---FINANCIAL_CRITERIA---
Minimum Average Annual Construction Turnover of the best 3 years within the last 10 years: NRs. 3,92,50,000.00
All pending litigation shall be treated as resolved against the Bidder and so shall in total not represent more than 75% percent of the Bidder's net worth.
Submission of audited balance sheets and income statements, for the last 5 years to demonstrate the current soundness of the Bidder's financial position. As a minimum, a Bidder's net worth for the last year calculated as the difference between total assets and total liabilities should be positive.
Financial resources such as liquid assets, unencumbered real assets, and other financial resources (other than any contractual advance payments) to meet the cash-flow requirement of NRs. 1,09,16,000.
Required Bid Capacity of the bidder should be equal to or more than the NRs. 2,61,99,000.
The Bidder shall furnish a bid security, from Commercial Bank or Financial Institution eligible to issue Bank Guarantee as per prevailing Law in Nepal with a minimum of NRs. 7,55,000 which shall be valid for 30 days beyond the validity period of the bid.
If bid price of the bidder selected for acceptance is up to 15 (fifteen) percent below the approved cost estimate, the performance security amount shall be 5 (five) percent of the bid price.
For the bid price of the bidder selected for acceptance is more than 15 (fifteen) percent below of the cost estimate, the performance security amount shall be determined as follows: Performance Security Amount = [(0.85 x Cost Estimate –Bid Price) x 0.5] + 5% of Bid Price. The Bid Price and Cost Estimate shall be without VAT and Contingencies but including Provisional Sum.
The amount of the performance security be increased by Eight (8) percent of the quoted bid price without VAT but Including PS. (related to ITB 35.5)
If a bidder quotes a bid price that is more than thirty percent (30%) below the approved cost estimate, the amount of the performance security be increased by Eight (8) percent of the quoted bid price without VAT but Including PS. (related to ITB 35.8)
Bidder filing application against decision related to bid security pursuant to ITB 25.8 shall furnish a cash amount or Bank guarantee equivalent to ten percent (10 %) of amount of bid security.
Bidder filing application against decision related to notification of award pursuant to ITB 39.1 shall furnish a cash amount or Bank guarantee equivalent to one percent (1%) of its quoted Bid amount.
The Project Manager may withhold the amount stated in the SCC from the next payment certificate, which is NRs.100,000, for late submission of an updated Program.
The minimum insurance cover for loss of or damage to the Works, Plant and Materials is: 115% of the Contract Amount.
The maximum deductible for insurance of the Works and of Plant and Materials is: Nrs.100,000.
The minimum cover for loss or damage to immovable Equipment/plants is: 100 % (i.e Replacement Cost).
The maximum deductible for insurance of immovable Equipment/plant is: Nrs.100,000.
The minimum cover for loss of or damage to other property is: Nrs.100,000 with unlimited number of occurrences.
The maximum deductible for insurance of other property is: Nrs.100,000.
The minimum cover for personal injury or death insurance for the Contractor’s employees is that specified in the Labor act of Nepal.
The minimum cover for personal injury or death insurance for other people is: Nrs.100,000 with an unlimited number of occurrences.
Prevailing Interest Rate for late payment: 10 %.
The Contract is not subject to price adjustment.
The proportion of payments retained is: 5 (five) percent for GoN Funded.
The liquidated damages for the whole of the Works are 0.05 Percent of the final Contract Price (without VAT but including PS) per day. The maximum amount of liquidated damages for the whole of the Works is 10 Percent of the final Contract Price (without VAT but including PS).
The provision of bonus is Not Applicable in the contract.
Advance Payments are Applicable in the contract. The Advance Payments shall be: 20 percent of initial contract amount (without VAT but including PS) and shall be paid in two equal installments (i) 10% Mobilisation on site, (ii) 10% After works starts.
Deductions from Payment Certificates will commence in the first certificate in which the value of works executed exceeds 30% of the Contract Price. Deduction will be at the rate of 20% of the respective Monthly Interim Payment Certificate until such time as the advance payment has been repaid; provided that the advance payment shall be completely repaid prior to the end of 80 % of the approved contract price.
Recover interest on the advance amount from the Contractor should be at a rate of 10 %.
The Performance Security amount is: 5% of the contract agreement amount.
The amount to be withheld for failing to produce “as built” drawings and/or Operating and maintenance manuals is: ………….[Insert Amount].
Maximum number of days for delay resulting in fundamental breach of contract: 200 days.

---EXPERIENCE_CRITERIA---
Minimum Work experience of similar size and nature: At least one project of size NRs. 1,04,79,000.00
The Bidder, including all parties constituting the Bidder, shall be ineligible to participate in the open competitive bidding process if it has already secured five (5) number of construction contracts (in open competitive bidding) and has not yet completed the work as stipulated in the respective contracts.
This does not count contracts where:
a) tenders were invited or contracts accepted before 2078-12-03 B.S (March 17, 2022 A.D).
b) tenders were invited and contracts accepted after 2078-12-03 B.S (March 17, 2022 A.D) but the work acceptance report has been approved according to Rule 117 of PPR.
c) tenders were invited or contracts accepted under all types of foreign assistance.
Experience under construction contracts in the role of contractor, subcontractor, or management contractor for at least the last 5 years prior to the applications submission deadline.
Specific Construction Experience for Works with value up to NRs. 100 million: Participation as Prime contractor, management contractor, or subcontractor, within the last ten (10) years, in at least One (1) Contract with a value of at least NRs 1,04,79,000 that have been successfully or are substantially completed and that are similar to the proposed works. The similarity shall be based on the physical size, complexity, methods, technology or other characteristics as described.
Construction Experience in Key Activities: Participation as Prime contractor, management contractor, or subcontractor, within the last ten (10) years, for the above or other contracts stipulated in 2.4.2(a) above, a minimum annual production rate on construction experience in the following key activities that have been successfully or substantially completed:
Brick works: 137 m3
M20 Concrete works: 131 m3
Reinforcement Steel Rebar: 21957 K.G.
For subcontracting when permitted:
1) Completion of 80% of the amount in NRs. with similar size and nature of the work being sub contracted.
2) Average Annual Construction Turnover for the work being sub contracted should be at least 1.5 * V/T where V is the proposed value of sub contract and T is estimated time in year for which the intended sub-contracting work is to be completed. For intended Sub contracting work duration of up to 1 year, T shall be “1”.
Personnel Requirements:
1. Project Manager: 1 required, Masters in Civil Engineering, 5 years total work experience, 2 years experience in similar works.
2. Civil Engineer: 1 required, Bachelor in Civil Engineering, 5 years total work experience, 2 years experience in similar works.
3. Civil Sub-Engineer: 1 required, Diploma in Civil Engineering, 5 years total work experience, 2 years experience in similar works.
4. Electrical Engineer: 1 required, Bachelor in Electrical Engineering, 5 years total work experience, 2 years experience in similar works.
5. Sanitary Engineer: 1 required, Bachelor in Engineering, 5 years total work experience, 2 years experience in similar works.
6. Site Supervisor: 1 required, SLC/SEE, 5 years total work experience, 3 years experience in similar works.
Equipment Requirements:
1. Truck / Tripper: 1 required.
2. Tractor: 1 required.
3. Concrete Mixture Machine with Lift: 2 required.
4. Generator: 1 required.
5. Needle Vibrator (Operated Petrol): 2 required.
6. Monkey Jumper: 1 required.
7. Theodolite/Level Machine: 1 required.
8. Iron Props: 500 required.
9. Water Tanker: 1 required.
